Triumph Studio and/or its licensors own the website and its content unless otherwise specified.
Your Obligations
Using this website (or any part of it) illegally is prohibited, and you agree to abide by all applicable laws;
You will not copy, store, or distribute any material that contains (or is connected to) spyware, computer viruses, Trojan horses, worms, keystroke loggers, rootkits, or other harmful computer software on this website.
It is prohibited to perform systematic or automated data collection activities on or with this website without Triumph Studio’s express written authorization. This includes, but is not limited to, scraping, data mining, data extraction, and data harvesting.
You must not use this website for sending unsolicited commercial communications. You must not use this website for any marketing purposes without Triumph Studio’s express written consent.
Indemnity
In the event of any breach of the Conditions by you, or any other liabilities arising out of your use of the Website, or if anybody else accesses the Website through your PC or internet account, you agree to be liable for (and to indemnify us against) all claims, liability, damages, losses, costs, and expenses, including legal fees arising out of any breach of the Conditions by you.
Consequential Loss
We will not be liable for any loss or damage that you may suffer due to any delay in performance or completion of our contract, however that delay occurs.
Our Fees and Deposits
The payment process varies depending on the services you select. We reserve the right not to commence any work until the deposit has been paid as per the stated contract.
The work is completed as stated in the contract but is subject to the terms of the “approval of work” and “rejected work” clauses.
The deposit is not refundable if the development work has been started and you terminate the contract through no fault of ours.
Additional Expenses
Any expenses that are not included in our contracts, such as the purchase of templates, third-party software, stock photographs, fonts, domain name registration, web hosting, or comparable expenses, must be reimbursed by you.
Approval of Work
On completion of the work, you will be notified and have the opportunity to review it depending on the services you have taken. Please notify us in writing of any unsatisfactory points within 3 days.
If no report of unsatisfactory work has been made in writing to us within 3 days, then the work will be considered approved. After a project has been approved, it cannot be revised or rejected later.
Rejected Work
During the 3-day review period, if you do not approve our subsequent work to remedy any unsatisfactory points, we reasonably consider that your rejection of the work was unreasonable, then we have the right to end this agreement and take steps to recover payments for our services.
Search Engines
There is no guarantee of a specific search engine ranking for your website. However, we adhere to current best practices when optimizing your website.
Backups
If client advises then we will take back up of the data. Otherwise, we will not be responsible for restoring any client data or client websites unless such loss is the result of a negligent act or omission on our part. Furthermore, any conflict that arises during backup due to previously existing viruses or corrupted files will not be the responsibility of Triumph Studio.
Domain and Hosting
If needed domain and hosting may be provided to the client on a set cost depending on the package selected for 1 year or 12 months. After the completion of the said time, the charges of both the domain and hosting will be the responsibility of the client himself. A yearly renewal can also be provided by us at an additional cost.
Cross-Browser Compatibility
Using the most recent versions of well-supported content management systems, such as “WordPress”, we strive to make the websites we develop compatible with all modern browsers, including the most recent versions of Internet Explorer, Firefox, Google Chrome, and Safari.
Some third-party extensions may not be compatible with all browsers. Where incompatibilities are found, we will try to substitute alternative extensions or implement other solutions, as best we can.
User content
“User content” is any material (such as text, images, audio, video, or audio-visual material) you submit to this website, whatever the reason may be.
User content can neither be illegal nor unlawful, nor may it infringe upon any third party’s rights, nor may it give rise to any legal action against Triumph Studio, or against any other third party (as applicable).
No user content may be submitted to the website that is or has ever been the subject of a legal proceeding or similar complaint.
This website and Triumph Studio’s servers, as well as any content hosted or published on the website, are subject to editing or removal by Triumph Studio.
Force Majeure
Any contract set with Triumph Studio comes to an end when everything specified in that contract has been done. The contract can also be ended by mutual agreement of the parties involved in the contract or when it becomes impossible to carry out the obligations specified in the contract like due to man-made calamities (riots, acts of terrorism, war, etc.) or natural calamities (like a flood, hurricane, earthquake, volcanic eruption, etc.)
Updating this statement
Triumph Studio may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website.
By continuing to use the Website (or any part of it) after such a change, you agree to accept such change. You must immediately cease using the Website if you do not agree to any change in the Conditions.
Entire agreement
These terms and conditions constitute the entire agreement between you and Triumph Studio in regards to your use of this website. All previous agreements between you and Triumph Studio in relation to the use of this website have been superseded by these terms and conditions.
Law and jurisdiction
These terms and conditions will be governed by and construed in accordance with Australian Law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
